Law of Crimes (IPC)

Q. 1 What is an attempt to commit an offence? Distinguish between Preparation and Attempt. What do you mean by attempt to commit murder? Whether without causing injury can a person be held guilty of attempt to commit murder? Do the elements of Sec 511 (attempt to commit an offence) apply to section 307, 308, & 309 (attempt to commit murder, culpable homicide, and Suicide)?
A, the licensee of a petrol pump, and his 9 yr old brother are caught adulterating petrol in an underground storage. What offence is committed by A and his brother?

Q. 2 How far is mistake of fact, accident, act of child, insanity, and intoxication are valid and good defences under IPC? In IPC, mistake of law is no defence but mistake of fact is a good defence. How? What exemptions have been given by IPC to minors for an offence under General Exceptions? What has to be provided by a person claiming immunity from criminal liability on the ground of Insanity?

Q. 3 Define the right of Private Defence. When is this right not available? When does this right extend to causing death?

Q. 4 What do you understand by culpable homicide? When is culpable homicide murder and when is it not murder?

Q. 5 Define Hurt and Grievous Hurt. Explain the difference.

Q. 6 What is meant by kidnapping from India and kidnapping from guardianship and abduction? Differentiate between Kidnapping and Abduction.

Q. 7 Define and explain Theft. How is Theft different from Extortion? Under what circumstances Theft becomes Robbery? Can a man commit theft of his own property? A finds a valuable ring on the road. A sells it immediately without attempting to find the true owner. Is A guilty of any offence? Differentiate between Robbery and Dacoity.

Q. 8 Define Rape. Can a person commit rape with his wife? (Sec 375)

    According to IPC human body, whether living or not or its part are not movable property within the meaning of Section 22 of the Code as it is not owned by any person therefore theft of human body or its parts is not possible where as mummy or body, or its part or skelton is preserved for study or research purpose then it is a movable property as it is owned by some institution i.e. museum or educational istitutuion or research organistion etc., stealing the same would amount to theft. Transplantaion of Human Organs Act, 1994 penalises certain acts committed with respect to body.

    Human body is not considered to be a property so the question of movable/immovable does not arise
    Look up for definition of man/woman and human being in ipc
    And definition of goods(property) in sale of goods act :no-comments:
